SHORT TERM RENTAL AGREEMENT

This Short Term Rental Agreement (the “Agreement”) is made by and between The Borts Family Trust (“Landlord”) and Tenant as of the date set forth on the signature page of this Agreement.

The parties agree as follows:

PREMISES. In consideration of the Lease Payment, Landlord leases to Tenant the Premises and the Furnishings hereinafter set forth (collectively the “Premises”) located on Santa Fe Avenue, Del Mar, CA 92014.

TERM. The lease term will begin at 3:00 PM on the date of your Airbnb reservation and will terminate on the last day of your Airbnb reservation at 11:00 AM (the “Lease Term”). Exceptions to check in and check out times must be pre-approved by Landlord. When given advanced notice, Landlord will attempt to accommodate exceptions. Non-approved exceptions will result in a charge of (5%) of the nightly rate for every half-hour before 3:00 pm or late departure after 11:00 am.

LEASE PAYMENT. Tenant shall pay to Landlord as rent the sums payable pursuant to the terms of the Airbnb reservation (the “Lease Payment”). Upon receipt and execution of the Lease, Tenant shall deliver to Landlord the executed Lease and make payment pursuant to the terms on Airbnb.

MAXIMUM OCCUPANCY: The maximum occupancy (adults and children) of the Property is 10 persons at anytime. No more than 10 guests shall be in the home at any one time. If at any time the Premises is occupied by more than the Maximum Occupancy, the Landlord shall have the option to declare Tenant to be in breach of this Agreement, and Landlord shall be entitled to require all persons occupying the Premises to immediately vacate the Premises or take measures to have all persons removed from Premises and Tenant shall automatically forfeit the right to the return of any unused Rental Fees and/or shall forfeit the Security deposit, at Landlord’s discretion.

POSSESSION. Tenant shall be entitled to possession on the first day of the Lease Term, and shall yield possession to Landlord on the last day of the Lease Term, unless otherwise agreed by both parties in writing prior to the expiration of the Lease Term. At the expiration of the Lease Term, Tenant shall return copies of all keys or opening devices to the Premises; remove its goods and effects and peaceably; vacate any/all parking and/or storage space, and return the Premises to Landlord in as good a condition as when delivered to Tenant, ordinary wear and tear excepted. Unless otherwise provided for in the Lease, in the event of any damage to the Premises, Tenant shall be liable and responsible for all costs and expenses necessary, within the sole judgment and absolute discretion of Landlord, to remedy such damage. Landlord shall notify Tenant in writing of the amount of the costs and expenses to remedy such damage, together with an accounting thereof, and Tenant shall forthwith remit to Landlord such amount.

FURNISHINGS. Landlord will provide the following furnishings: washer, dryer, refrigerator, range, BBQ, dishwasher, TV, beds, dressers, couches, chairs, furniture, vacuum, kitchenwares, kitchen appliances and tables in addition to lamps, linens, towels, housewares and beach items. Tenant shall return all such items at the end of the Lease Term in a condition as good as existed at the beginning of the Lease Term, normal wear and tear excepted. Its agreed that stains, burn holes,

ALTERATIONS: Tenant shall not paint, wallpaper, alter or redecorate, change or install locks, window coverings, wall hangings, install fixtures of any kind, install antenna or other equipment, screws, fastening devices, nails, or adhesive materials, place signs, displays, or other exhibits, on or in any portion of the premises without the written consent of the Landlord except as may be provided by law.

UTILITIES AND SERVICES. Landlord shall be responsible for and pay the cost of providing water, sewer, garbage collection, electricity, TV cable/satellite, gas and wireless internet to the Premises. Landlord shall have the responsibility to maintain the Premises in good repair at all times and perform all repairs reasonably necessary to satisfy any implied warranty of habitability in addition to having the Premises professionally cleaned prior to the commencement of the Lease Term. During the Lease Term, Tenant, at its sole cost and expense, shall have the sole responsibility of keeping the Premises in a clean condition.

HABITABILITY. Tenant acknowledges and agrees that the Premises and fixtures are in a reasonable and acceptable condition of habitability for their intended use, and the agreed Lease Payment is fair and reasonable.

CONDITION OF PREMISES: Tenant shall upon arrival examine the premises, all furniture, furnishing, appliances, fixtures and landscaping and shall immediately report in writing, if any are not in operating condition or are in disrepair. Reporting repairs does not give Tenant the right to cancel this Agreement or receive a refund of any payments made.

Tenant agrees to keep the premises and all items in good order and good condition and to immediately pay for costs to repair and/or replace any portion of the above damaged by Tenant, their guests and/or invitees, except as provided by law. At the termination of this Agreement, all of above items in this provision shall be returned to Landlord in clean and good condition except for reasonable wear and tear and the premises shall be free of all personal property and trash not belonging to Landlord. It is agreed that all dirt, holes, tears, burns, and stains of any size or amount in the carpets, bedding, drapes, walls, fixtures, and/or any other part of the premises, do not constitute reasonable wear and tear.

MAINTENANCE: Tenant shall properly use, operate and safeguard the Premises including, if applicable, any landscaping, furniture, furnishing, appliances, and all mechanical, electrical, gas and plumbing fixtures, and keep them clean and sanitary. Tenant shall immediately notify Landlord of any problem, malfunction or damage. Tenant shall pay for all repairs or replacements cause by Tenant, guests and licensees of Tenant, excluding ordinary wear and tear. Tenant shall pay for all damage to the Premises as a result of failure to report a problem, malfunction or damage in a timely manner. Tenant shall pay for repair of drain blockages or stoppages, unless caused by defective plumbing parts or tree roots invading sewer lines.

INSPECTION/REPAIR. Landlord or Landlord’s agents may enter the Premises upon reasonable notice to Tenant in order to inspect the Premises, to make necessary repairs, alterations or improvements, or to supply necessary or agreed to services; to verify that occupant has complied with the terms of this agreement; or to show the Premises to prospective purchasers, tenants or appraisers; or in case of an emergency.

USE OF PREMISES/ABSENCES. Tenant shall occupy and use the Premises as a dwelling unit and shall notify Landlord of any anticipated extended absence from the Premises not later than the first day of the extended absence. Tenant shall not make any alterations to the Premises or to any fixtures or furnishings in or on the Premises.

LAWS AND RENTAL RULES AND REGULATIONS: Tenant agrees to abide by the Rental Rules attached as Exhibit “A” at all times while on the Premises and shall cause all members of the rental party and anyone else Tenant permits on the Premises to so abide. Tenant shall comply with all statutes, ordinances and requirements of all municipal, state and federal laws regarding the Property, including the use, possession, production or sale of illegal drugs. If Tenant and/or its guests and invitees do not abide by the aforementioned laws, Rental Rules and/or regulations, they are in breach of this Agreement and may be required to immediately leave or be removed from the Premises. Tenant forfeits its right to return of any security deposit and/or unused rent.

PETS. Pets shall not be allowed, unless previously consented to in writing by Landlord, which consent shall be within the sole and absolute discretion of the Landlord. If the Tenant violates this no-pet policy, Tenant will be required to immediately vacate the Premises or shall be removed therefrom. Tenant forfeits the right of the return of any unused Rental Fees. Tenants violating this no-pet policy will forfeit a minimum cleaning fee of $500 from the security deposit and shall be charged for all costs incurred by Landlord to repair any damages to the Premises caused by pets.

In the event Landlord consents in writing, Tenant shall be responsible for any damage incurred as a result of any pet and agrees to return the Premises to the Landlord at the end of the Lease Term in the same exact condition as the Premises were delivered to the Tenant at the commencement of the Lease Term. In the event of any damage to the Premises, Tenant shall be liable and responsible for all costs and expenses necessary, within the sole judgment and absolute discretion of Landlord, to remedy such damage. Landlord shall notify Tenant in writing of the amount of the costs and expenses to remedy such damage, together with an accounting thereof, and Tenant shall forthwith remit to Landlord such amount.

DANGEROUS MATERIALS. Tenant shall not keep or have on the Premises any article or thing of a dangerous, flammable, or explosive character that might substantially increase the danger of fire on the Premises, or that might be considered hazardous by a responsible insurance company, unless the prior written consent of Landlord is obtained and proof of adequate insurance protection is provided by Tenant to Landlord.

SMOKE-FREE PREMISES. Tenant understands and agrees that there shall not be any smoking of any kind on the Premises and further agrees to keep and maintain the Premises smoke-free. In the event there is evidence that smoking has occurred on the Premises during the Lease Term (including but not limited to stains, burns, odor or debris), Tenant shall be liable and responsible for all costs and expenses necessary, within the sole judgment and absolute discretion of Landlord, to remedy the matter. Tenant violating this no-smoking policy will forfeit a minimum additional cleaning fee of $500 from the security deposit. Landlord shall notify Tenant in writing of the amount of costs and expenses incurred to remedy the matter, together with an accounting thereof, and Tenant shall forthwith remit to Landlord such amount.

If Tenant violates the no-smoking policy, Tenant may be required to immediately vacate the Premises, or may be removed, in which case the Tenant forfeits all rights to the return of any unused Rental Fees.

PROPERTY INSURANCE. Landlord and Tenant shall each be responsible to maintain appropriate insurance for their respective interests in the Premises and property located on the Premises. Landlord recommends that Tenant carry or obtain insurance to protect Tenant, guests and licensees and their personal property from any loss or damage.

OWNER INSURANCE: Tenant acknowledges that Landlord’s insurance does not cover any of Tenant’s or Tenant’s invitees’ personal property, including vehicles, against loss or damage due to fire, theft, vandalism, rain, water, criminal or negligent acts of others, or any other cause. Owner does not insure against personal injury to Tenant, guests or licensees due to any reason other than the condition of the Premises.

INDEMNITY REGARDING USE OF PREMISES. Tenant will indemnify, defend and hold harmless Landlord, owner of the Premises and their agents, representatives, attorneys and assignees (“Released Parties”) from all claims, disputes, liabilities, demands, causes of action, litigation, judgments, costs, expenses, and attorneys’ fees, arising out of, related to or any manner whatsoever connected to Tenant’s use or occupancy of the Premises while in Tenant’s care, custody and control, including but not limited to injury to Tenant, Tenant’s guests, invitees and licensees, and damage to their personal property, except for any negligence by Released Parties. Released Parties shall not be liable for any damage or injury to Tenant, or any other person, or to any property, occurring on the Premises. Tenant agrees to waive and release the Released Parties from any and all liability for costs, expenses or damages due to loss of property or for personal injuries or death (“Claims”) which may occur to Tenant and/or Tenant’s guests, invitees and licensees while on or about the Premises, except for injury or damage caused by the negligence or willful misconduct of the Released Parties. Tenant hereby assumes the risk of a Claim while using the Premises. This waiver and release is intended to be a full and complete waiver and release of the Released Parties from any and all present or future Claims (known or unknown), except for injury or damage caused by the negligence or willful misconduct of the Released Parties.

HOLDOVER. If, with the prior written consent of Landlord, which consent shall be within the sole and absolute discretion of Landlord, Tenant maintains possession of the Premises for any period after the expiration of the Lease Term (“Holdover Period”), Tenant shall pay a charge of 1 and 1/2 times the daily prorated rate plus any additional damages incurred including, but not limited to the cost of alternative housing for guests displaced by Guest’s holding over. Such holdover shall constitute a day to day extension of the Lease.

ASSIGNABILITY/SUBLETTING. Tenant shall not assign or sublease any interest in the Premises, nor assign, mortgage or pledge the Lease, without the prior written consent of Landlord, which consent shall be within the sole and absolute discretion of Landlord.

DEFAULTS. Tenant shall be in default under the Lease if Tenant fails to fulfill any obligation or term by which Tenant is bound under the Lease. Subject to any governing provisions of law to the contrary, if Tenant fails to cure any financial obligation within 5 days (or any other obligation within 10 days) after written notice of such default is provided by Landlord to Tenant, Landlord may elect to cure such default and the cost of such action shall be added to Tenant’s obligations under the Lease and Tenant shall immediately pay and remit such cost to Landlord. All sums of money or charges required to be paid by Tenant under the Lease shall be additional rent, whether or not such sums or charges are designated as “additional rent.” The rights provided by this paragraph are cumulative in nature and are in addition to and not in lieu of any other rights afforded Landlord at law or in equity.

CANCELLATION POLICY: Upon receipt by Landlord of the Lease Payment, in the event that Tenant cancels the Lease, Tenant acknowledges, understands and agrees that reservation, deposit and all rent paid will be refunded only pursuant to the terms of Airbnb. There are no exceptions. The security deposit will be returned in full 14 days after departure provided no outstanding expenses have been incurred.

REFUND POLICY: Landlord cannot guarantee against mechanical failure of heating, air conditioning, TV, Internet or Cable receivers, or any other appliance, large or small. Please report any inoperative equipment to Landlord immediately who will make every reasonable effort to have the repairs done quickly and efficiently. NO REFUNDS OR RENT REDUCTIONS will be made due to failure of appliances or equipment. NO REFUNDS OR RENT REDUCTIONS will be made for early departure (fewer days than reserved) or delayed arrivals (checking in later than 4pm on arrival date). Landlord shall not be liable for events beyond their control which may interfere with Tenant’s occupancy, including but not limited to Acts of God, acts of governmental agencies, fire, strikes, war, inclement weather or noise from nearby construction. NO REFUND OR RENT REDUCTIONS will be offered due to these circumstances.

UNAVAILABILITY: If for any reason beyond the control of the Landlord the Premises is not available, Landlord may cancel this agreement and refund in full to Tenant all payments made.

NOTICE. Notices under the Lease shall not be deemed valid unless given or served in writing by email provided below. Such addresses may be changed from time to time by either party by providing notice as set forth below. Notices mailed in accordance with these provisions shall be deemed received on the third calendar day after sending.

GOVERNING LAW. The Lease shall be construed in accordance with the laws of the State of California.

ENTIRE AGREEMENT/AMENDMENT. The Lease, Exhibit “A” attached hereto and the Pet Addendum if applicable, contain the entire agreement of the parties. There are no other promises, conditions, understandings or other agreements, whether oral or written, relating to the subject matter of the Lease. The Lease may be modified or amended in writing, if the party obligated under the amendment signs the modification or amendment.

SEVERABILITY. If any portion of the Lease shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of the Lease is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.

CUMULATIVE RIGHTS. The rights of the parties under the Lease are cumulative, and shall not be construed as exclusive unless otherwise required by law.

WAIVER. The failure of either party to enforce any provisions of the Lease shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with each and every term and provision of the Lease.

BINDING EFFECT. The provisions of the Lease shall be binding upon and inure to the benefit of both parties and their respective legal representatives, successors and assigns, subject to the provisions herein contained pertaining to ASSIGNABILITY/SUBLETTING.

The parties agree to the terms of this Short Term Rental Agreement, as evidenced by the signatures set forth below. An electronic or manual signature is acceptable.

RENTAL RULES

1. Smoking is NOT allowed.

2. People other than those in the Rental Party may not stay overnight in the property. Any other person in the property is the sole responsibility of Tenant.

3. The Landlord is not responsible for any accidents, injuries or illness that occurs while on the premises to Tenants or persons invited onto the premises by Tenants. The Landlord are not responsible for the loss of personal belongings or valuables of the Guest. By accepting this reservation, it is agreed that all Guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise, whether caused by Homeowners negligence or otherwise.

4. Keep the property and all furnishings in good order or be charged a replacement fee subject to normal wear and tear.

5. Only use appliances for their intended use.

6. Pets are permitted only with prior approval and the Pet Addendum must be completed. 

7. This is a quiet residential neighborhood where neighbors typically keep their windows open. Please be aware of the volume of your group and be respectful of the neighbors.

8. Absolutely no parties or functions at which more persons are present than permitted by the Maximum Occupancy for the Premises (“Gatherings”) are permitted without clear written approval from the Landlord. In order to host a Gathering, the Tenant must sign a Special Events Agreement. Tenants shall be quiet and peaceful, so as to respect and not to disturb other residents of the neighborhood.

9. Parking is limited to the driveway.  Parking on the street is permitted, but spaces fill up quickly during weekends and holidays. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner.

10. There is no daily housekeeping service unless you wish to arrange it with the Landlord for an additional fee. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. Any beach towels taken from the unit to the beach must be returned to the unit to avoid being charged a replacement fee.

11. The fireplace is a gas log fireplace. Please do not throw any paper or other combustible materials in the fireplace. Please ensure the flue is open and remains open during fireplace operation. Please ensure you turn the gas off after use. Landlord will not be responsible for damage or injury caused to Tenant or their invitees resulting from improper use to the fireplace.

12. Do not flush anything other than toilet paper down the toilet. No feminine products or baby wipes should be flushed at anytime. If it is found that feminine products or baby wipes have been flushed you could be charged the cost of plumbing repairs if required.

13. Please lock all doors when not on the Premises.

14. No refunds will be given for storms or on account of bad weather.

15. CHECK OUT POLICY (Please follow the Check Out Checklist which is provided in the Guest Binder, which is on the dining table). Please have the house as clean as possible, clear out the fridge, run the dishwasher and remove any trash to the appropriate receptacles outside. Trash is collected on Monday. Anything that does not fit into the trash receptacles will need to be taken to a local dumping station. Please pull off all used sheets and towels and leave them at the floor of the bed. (Please leave duvets and shams as is) All doors should be locked, windows closed and air conditioning units off. I will contact you regarding how to return the key.

We are local San Diegans with a young family who love the beach! We know you will too! We love this house as is it right in the middle of all Del Mar has to offer, the sand, the surf, the racetrack and fair. Walking distance to Del Mar Village, fine dining and shopping. No need to leave, but should you want to go see more of San Diego, you are close enough to other main attractions - the zoo, Legoland, Seaworld, the Wild Animal Park. If you want to venture downtown to the GasLamp District, you could go see the Padres play or visit Seaport Village. Lots of historical buildings and museums in Balboa Park. Can't beat America's Finest City! That is why we love it here.
